Indian Trail Permitting
Indian Trail has a genuine two-step permitting process, and taking the steps out of order is the most common reason a back yard project here stalls. The Town goes first, Union County goes second, and the County will not close the job out until the Town signs off.
A Planning Technician at the Town of Indian Trail processes the zoning permit for an accessory structure or addition. At submission the Town requires a completed application, payment of the fee, and a site plan or survey — applications can be handled in person, online or by mail (Town of Indian Trail residential accessory structures).
After the zoning permit is issued, a Union County building permit may also be required. By the Town's own guidance, that typically applies to all structural residential additions, accessory structures over 120 square feet, accessory structures over 12 feet in height, and any structure requiring electrical, plumbing or mechanical work. If your pergola is 121 square feet or you want power run to it, that is a County permit.
Once the work is finished, the Town's Code Enforcement office (704-821-5401) performs a zoning compliance inspection. If a County building permit was pulled, Union County will withhold final approval until Indian Trail's zoning compliance certification is released. Missing that last step is how a finished project ends up with an open permit on the property.
The Town treats a covered patio, an attached pergola or an attached deck as a residential addition, which means it has to sit inside the same setbacks as the principal house — shown on your survey — and the materials have to match the main structure. An architectural rendering may also be required. Detaching a structure instead of attaching it sometimes avoids the setback problem entirely, and that is a design decision worth making before the quote, not after.

Common Questions
Two, potentially. First a zoning permit from the Town of Indian Trail, processed by a Planning Technician and requiring a completed application, the fee and a site plan or survey. Then a Union County building permit, which typically applies to structural additions, accessory structures over 120 square feet or over 12 feet tall, and anything needing electrical, plumbing or mechanical work.
Yes. Indian Trail treats a covered patio, attached pergola or attached deck as a residential addition, so it has to conform to the principal house setbacks shown on your survey, and the materials have to match the main structure. An architectural rendering may be required. Building the structure detached instead sometimes sidesteps the setback issue — worth deciding at design stage.
Per the Town's guidance, a Union County building permit is typically required for accessory structures over 120 square feet in area or over 12 feet in height, for all structural residential additions, and for any structure requiring electricity, plumbing or mechanical work. A 10x12 shed at 120 square feet and a 121-square-foot one are on opposite sides of that line.
The Town's Code Enforcement office performs a zoning compliance inspection once the work is complete. If a Union County building permit was involved, the County holds final approval until the Town releases its zoning compliance certification. We carry that through to closeout so you are not left with an open permit on the property.
Yes — a lot of our Union County work is patios, walkways, walls and drainage on subdivision lots in communities like Crismark, Bonterra Village and Brandon Oaks, plus full back yard renovations that turn a flat rectangle of lawn into usable outdoor rooms.
